Welcome to rSpace. These Terms of Service ("Terms") govern your access to and use of the website at rspace.online and the rSpace platform (collectively, the "Service" or "rSpace"), operated by rSpace ("we", "us", or "our"). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Accounts and Authentication

rSpace uses passkey-based authentication via EncryptID and WebAuthn. You are responsible for safeguarding the devices and credentials used to access your account. We will never ask you for a password, seed phrase, or private key.

3. Your Content

You retain all rights to the content you create, upload, or share through the Service ("Your Content"). You grant rSpace a limited, worldwide, royalty-free license to host, store, transmit, and display Your Content solely as necessary to operate the Service and provide it to you and the people you choose to share with.

You are solely responsible for Your Content and for the lawful basis on which you process any personal information of others through the Service.

Portions of the Service are released under open-source licenses. Where applicable, those licenses govern use of the corresponding components and are not superseded by these Terms.

6. Payments

Some features may require payment. Fees, billing cycles, and refund policies are disclosed at the time of purchase. Payments are processed by third-party providers (e.g., Stripe, Mollie); their terms and privacy policies apply to those transactions.

7. Third-Party Services

The Service integrates with third-party services (payment processors, AI providers, calendar systems, federated identity providers, and others) at your option. We are not responsible for the availability, accuracy, or content of third-party services.

8. Beta and Experimental Features

Some features are offered as beta, alpha, or experimental. They may be incomplete, change without notice, or be discontinued. They are provided on an "as is" basis without any warranty.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if required by law or operational necessity. Because rSpace is local-first, copies of Your Content stored on your devices remain in your possession after termination.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RSPACE AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) EUR 100.

You agree to defend, indemnify, and hold harmless rSpace from any claims, losses, or damages arising out of Your Content or your breach of these Terms.

13. Governing Law and Venue

These Terms are governed by the laws of the European Union and the jurisdiction in which the operating entity is established, without regard to conflict-of-law principles. Disputes will be resolved in the competent courts of that jurisdiction, except where mandatory consumer-protection law provides otherwise.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
